INLAND WETLANDS AND WATERCOURSES COMMISSION
REGULAR MEETING
MAY 27, 2014
PRESENT WERE: Skip DiCamillo, Stanley Kolber, Dave McCulloch, Mike Moran, Tim Rollins and Evan Griswold.
Chairman DiCamillo called the meeting to order at 7:00 p.m.
MINUTES
Evan Griswold made a motion to approve the April 22, 2014 Regular Meeting Minutes. Tim Rollins seconded the motion. The motion passed unanimously.
NEW BUSINESS
14-10 DENNIS CHUPRON – 220-1 WHIPPOORWILL ROAD – 200 X 200 AGRICULTURAL IRRIGATION POND
Dennis Chupron and Chris Kerr were present to discuss the application. The applicant requested that the commission make a determination that this is an agricultural use (digging an irrigation pond and planting crops) and so permitted by right. Ann Brown provided the commission with a copy of Section 4 of the Regulations – Permitted Uses as of Right and Non-regulated Uses. Kerr stated the proposal is to install an agricultural pond similar to what was done at Judge’s Farm and to develop the property into a tree farm and create a farming business. Kerr noted the pond will generate the water to do this. He further stated that there are no wetlands within the site. He noted when the pond was originally dug out for gravel use on I-95 it was dug 30 feet straight down and is all level.
DiCamillo asked if gravel would be removed from the site. Kerr stated that would be determined depending on how deep they had to dig but noted all of the gravel would be used to fill in low spots on the property as well as the driveway. Kerr stated if there was any excess it could be removed and given away. McCulloch stated there were several low areas on the property that could be filled and re-graded. He stated the wetlands would not be disturbed because of their location on the other side of berm. DiCamillo asked how far away from the wetlands it was located. Kerr stated it was over 100 ft. away from the wetlands.
The commission reviewed the site plan provided by the applicant as well as the aerial photography and photographs of the area.

Kolber asked if there would be any disturbance created by the machinery on the site. Chupron stated there is a gravel access from the road right into the area. McCulloch noted that the driveway was well constructed and could handle any equipment that would be brought into the site.
Evan Griswold made a motion to make a determination of no jurisdiction based on the facts presented at the meeting. Dave McCulloch seconded the motion. The motion passed unanimously.
14-11 CAROL WINTERS – 12-1 WHIPPOORWILL ROAD – MAINTENANCE GRADING AND TOP DRESSING OF THE EXISTING DRIVEWAY
Carol Winter and her son, Chris were present to discuss the application. DiCamillo noted that Dave McCulloch observed the work being done. The commission reviewed the site plan and photographs submitted with the application. Chris Winter stated they had filled in the potholes to eliminate the 12 to 18” of standing water in the driveway and graded. He also noted they lowered an area approximately 3’ wide x 12’ long of grass to allow the water to leave the area.
DiCamillo asked if the work was completed. Mrs. Winter indicated they had been told to stop work and her son indicated the only remaining work to be completed was to dress the top of the driveway.
The commission agreed to set a Site Walk on Saturday, June 1st at 8:30 a.m.
DISCUSSION – BASIC COMMUNICATIONS AND OPERATIONS PROTOCOL
The commission discussed the policies and procedures draft document that was submitted by Stanley Kolber. The commission agreed to create a Wetlands Checklist to be attached to every application folder to establish a timeline until completion of the project. Groves will create a draft checklist for the commission to review.
Stanley Kolber made a motion to provide the draft “Basic Communications and Operations Protocol” with a proposed form of Checklist to the new Enforcement Officer for his information and review, and that the draft and proposed checklist be placed on the June agenda for action. Mike Moran seconded the motion. The motion passed unanimously.
